§ 1 GENERAL PROVISIONS

The Controller of personal data gathered through www.wheelstandpro.com Store is WSP Anna Bik , NIP tax identification number: 551 229 61 76 , REGON statistical number: 120616082 , principal place of business and address for service: ul. Podstawie 28a, 34-100 Wadowice, e-mail address: order@wheelstandpro.com, hereinafter referred to as the "Controller" and being the Service Provider at the same time.

Any words or phrases in this Privacy Policy beginning with capital letters have the meaning as defined in the Rules of www.wheelstandpro.com Store.

§ 2 PURPOSE AND SCOPE OF GATHERING DATA

Personal data shall be processed for the purposes of fulfillment of shopping orders at our Internet store, direct marketing of own products and services in traditional (paper) form, being the so called legally justified interest of the company. For this purpose, data shall be processed pursuant to art. 6 clause 1 i letters b), c) and f) of the Regulation of the European Parliament and the Council (EU) No. 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).

By a separate consent pursuant to art. 6 clause 1 letter a) of the GDPR, data may also be processed for the purpose of sending trade information through means of electronic communication or making phone calls for the purposes of direct marketing - in relation to art. 10 clause 2 of the Act of 18 July 2002 on the provision of electronic services or art. 172 clause 1 of the Act of 16 July 2002 - Telecommunications Law, respectively, including information targeted as a result of profiling, if the user has given a relevant consent.

If it is necessary to deliver an order, personal data may be shared with postal operators or carriers (DHL, UPS) solely for the purpose of delivery. Transaction details, including personal data, may be shared with an electronic payment operator (PayPal, PayU.pl) selected by the Client while placing an Order, to the extent necessary to process the payment for the Order. Personal data processed for the purposes related to the fulfillment of shopping orders shall be processed by a period necessary to fulfill the shopping orders. After that period, data subject to archiving shall be stored for a period relevant for the time barring of claims, i.e. 10 years. Personal data processed for marketing purposes covered by a consent shall be processed until the consent is revoked.

If it is found that the processing of personal data violates GDPR provisions, the person, to whom the data concerns, has the right to file a complaint to the General Personal Data Protection Inspector (since 25 May 2018 - the President of the Personal Data Protection Office).

Providing personal data is voluntary, however, providing specific personal data is necessary to place the order, otherwise it will be impossible to order any products from the store.

Personal data shall also be processed in an automated manner in the form of profiling if the user consents to it pursuant to art. 6 clause 1 letter a) of the GDPR. The profiling will result in the creation of a profile of a given person in order to make decisions concerning that person or to analyse or predict such person's preferences, behaviour and attitudes.

The Administrator uses his best efforts to protect the interest of persons, to whom the data concerns, in particular, the Administrator ensures that the data gathered by him is:

  • processed in accordance with the law,
  • gathered for specific, lawful purposes and not processed further contrary to such purposes,
  • proper and adequate for the purposes of processing and stored in the form allowing for identification of persons, to whom it concerns, for a period no longer than necessary to achieve the goal of the processing.
§ 3 RIGHT TO CONTROL, ACCESS AND CORRECT OWN DATA

The person, to whom the data concerns, has the right to access their data and to correct and remove them, limit the processing of such data, has the right to transfer such data, right to object, right to withdraw the consent at any time without the effect on the lawfulness of the processing made on the basis of the consent prior to the withdrawal.

§ 4 “COOKIE” FILES

The Service Provider’s store uses “cookie” files. If the Client makes no changes to the settings of their browser, it shall mean that the Client agrees to the use of cookies.

Installation of “cookie” files is necessary for the proper provision of services offered by the Store. “Cookie” files contain data necessary for the proper running of the Store, in particular functions requiring authorisation.

The Store uses three types of “cookie” files: “session”, "persistent” and “analytical” “cookie” files.

“Session” cookies are temporary files stored on the end device of the Client until logging out (leaving the Store).

“Persistent” cookies are stored on the Client's end device for the time defined in the “cookie” file parameters or until they are deleted by the User.

“Analytical” cookies make it possible to analyse the way the Client interacts with the contents of the Store to improve the Store's layout. “Analytical” cookies gather information on how the Client uses the Store, on the type of website, from which the Client was forwarded, as well as the number of visits and time spent by the Client on the Store's website. Such information do not store any specific personal details of the Client, but they are used to develop Store use statistics.

The Client has the right to decide how and if “cookie” files can access their computer by selecting the files in the Client's browser window. Detailed information on the methods and options for handling “cookies” are available in the software settings (web browser).

§ 5 FINAL PROVISIONS

The Administrator uses technical and organisational means ensuring security of the processed Personal Data suitable for the level of risk and category of protected data, in particular, the Administrator protects the data against access by unauthorised persons, stealing of such data, processing of the personal data in violation of the act, as well as amendment, loss, damage or destruction of such personal data.

The Service Provider provides suitable technical means protecting against stealing and modifying of personal data sent through e-mail by unauthorised persons.

In matters not regulated by this Privacy Policy, the provisions of www.wheelstandpro.pl Store Rules, provisions of the Regulation of the European Parliament and the Council (EU) No. 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), as well as other relevant provisions of the Polish law are applicable.

The provisions of this Privacy Policy enter into force on 25 May 2018.
